Neuroethics, in its modern form, investigates the impact of brain science in four basic dimensions: the self, social policy, practice and discourse. In this study, we analyzed a set of 461 peer-reviewed articles with neuroethics content, published by authors from 32 countries. We analyzed the data for: (1) trends in the development of international neuroethics over time, and (2) how challenges at the intersection of ethics and neuroscience are viewed in countries that are considered developed by International Monetary Fund (IMF) (...) standards, and in those that are developing. Our results demonstrate a steady increase in global participation in neuroethics from 1989 to 2005, characterized by an increase in numbers of articles published specifically on neuroethics, journals publishing these articles, and countries contributing to the literature. The focus from all countries was on the practice of brain science and the amelioration of neurological disease. Indicators of technology creation and diffusion in developing countries were specifically correlated with increases in publications concerning policy implications of brain science. Neuroethics is an international endeavor and, as such, should be sensitive to the impact that context has on acceptance and use of technological innovation. (shrink)

Methodological nationalism assumes that, to understand a phenomenon, nation- states are the relevant units of analysis. This assumption has been recognized as a source of bias in most of the social sciences. Does it bias Rawls' understanding of justice, too? This paper argues that it does for at least two reasons. Firstly, what Rawls thinks justice requires on a global scale falls short of what states and international organisations actually do. Secondly, framing the difference principle in national terms, as Rawls (...) did, is a way to increase the “citizenship rent”, or the revenue a person receives just by being citizen of a rich country The paper argues that methodological nationalism biases Rawls’ understanding of justice by affecting both the plausibility and the coherence of his theory. Proof requires a dialogue between agents to clarify obscure inference steps, fill gaps, or reveal implicit assumptions in a purported proof. Hence, argumentation is an integral component of the discovery process for mathematical proofs. This work presents how argumentation theories can be applied to describe specific informal features in the development of proof-events. The concept of proof-event was coined by Goguen who described mathematical proof as a public social event that takes place in space and time. This new meta-methodological concept (...) is designed to cover not only “traditional” formal proofs but all kinds of proofs and inference steps, including incomplete or purported proofs. Our approach attempts to make proof-events more comprehensive to express the complete trajectory of a mathematical proof-event until the ultimate validation of the proving outcome. Thus, we advance an extended version of proof-event calculus which is built on argumentation theories designed to capture the internal and external structure of collaborative mathematical practice and highlight the relationship between proof, human reasoning, and cognitive processes. In addition, another area in which argumentation can make a significant contribution is dealing with the defeasible knowledge of the Web which is a product of its open and ubiquitous nature. This approach seems to be sufficient for the presentation of Web-based proving processes as manifested in the case of the Mini-Polymath 4 project. (shrink)

Brain drain critiques and human rights advocates have conflicting views on emigration. From a brain drain perspective, the emigration harms a country when emigrants are skilled and the source country is poor. From the human rights perspective, the right "to leave any country, including one's own" is a fundamental right, protected for all, whatever their skills. Is the concern with poverty and social justice at odds with the right to emigrate? At the beginning of the l970s, the economist Jagdish Bhagwati (...) replied in the negative. He imagined a tax on the income earned by the skilled migrants in the destination country, to the benefit of the source country. He thus sought to reconcile the right to emigration and the brain drain effects. -/- This article argues that there is no need to tax skilled migrants in order to reconcile the right to emigration and social justice. Social justice is not incompatible with the right to emigration but rather with restrictions on mobility. If it is both the case that equal opportunities are a minimal requisite for social justice, and that access to opportunities implies freedom of movement, as I shall argue, then the brain drain criticism doesn't satisfy the minimal requirements of social justice. -/- The article is divided into three parts. Each part rejects one of the possible justifications of the Bhagwati tax, that is, as a way, for skilled migrants, (i.) to compensate the welfare loss occasioned to their country of origin; (ii.) to discharge for their obligation to the national community when it publicly financed their education; and (iii.) to compensate for the resulting inequality of opportunities between themselves and their non-migrant compatriots. Relationships to time through memory or projection form a particular axis along which the post-communist space reshapes, constructs and understands its identity. Caught between a public rejection of the communist past and a need for roots in the recent past, if only for narrative reasons, and cornered by the near future in the name of transition, the postcommunist societies face a dilemma in their search for identity. The weight of this dilemma can be directly measured by the level of consensus (...) around the passing of certain ‘reparation’ laws, such as the restitution of nationalised property or ‘lustration’, however it can also be seen in other public debates. This sheds light on the difficulties that a society may experience in adopting a collectively-accepted narrative, which then forms the basis on which it constructs its identity. (shrink)

The international system of obligatory passports, as it exists today, was established at the beginning of the First World War. After the Armistice, the League of Nations tried to abolish it, but several governments delayed it. This article analyzes how the French press of the interwar period called for the abolition of passports. Seen as a "vexation", the passport was deemed "useless" after the war. So why wasn’t it abolished? Among the reasons for maintaining passports, we explore the hypothesis of (...) political “utility”: the regime of obligatory passports enabled governments to refuse passports and thus to control the transnational activity of political opponents. Research ethics is increasingly formally regulated, but little is known about how ethical considerations are reported in dissertations. The aim of this literature study was to describe the status and trends of ethical considerations in Swedish doctoral dissertations written by registered nurses. A total of 77 dissertations from 1987, 1997, and 2007 met the inclusion criteria and were analyzed by descriptive statistics. Ethical considerations were mostly overlooked in 1987, but almost ubiquitous by 2007. All dissertations in 2007, except one, had (...) a section on ethical considerations; however, these were short, lacking in references, and short on content. The most common topic was informed consent and approval from research ethics review boards, followed by confidentiality and ethical aspects of methodological issues. Our results imply that the quantity and quality of ethical considerations must be improved in order to assure ethical soundness for participants, patients, researchers, and society. (shrink)

In political theory it goes without saying that the constitution of government raises a claim for legitimacy. With the constitution of the people, however, it is different. It is often dismissed as a historical question. The conviction is that since the people cannot decide on its own composition the boundaries of democracy must be determined by other factors, such as the contingent forces of history. This article critically assesses this view. It argues that like the constitution of government, the constitution (...) of the people raises a claim for legitimacy. The failure to see this is what makes many theorists run into the arms of history. They submit the legitimacy of the people to the arbitrary and asymmetrical forces of the present. (shrink)

Rawls' original position is a thought experiment by which we are asked to imagine ourselves as rational agents choosing the principles of justice under specific informational and motivational constraints. In this paper, I am concerned only with the informational constraints and I shall argue that the way Rawls designed them reveals an implausible conception of mind and knowledge. This conception, of a mind separable from knowledge, as well as one of its correlates which I will call epistemic egalitarianism, is not (...) an objection one may address uniquely to the original position. However, the failure to construct the original position as a one-solution problem renders its epistemology not only implausible but of no use for moral reasoning. (shrink)

Perceiving a pay system as just has been suggested to be a precondition for individualized pay to have a motivating effect for employees. Supervisors’ enacted justice is central for understanding the effects that pay setting can have on employee attitudes and behavior. Yet, enacted justice has received little research attention, in regard to both organizational justice and pay-related topics. This study examines the effects of employees’ perceived pay justice and supervisors’ enacted justice, as well as the degree of congruence, on (...) employees’ work-related attitudes and behaviors. Questionnaire data from employees (N = 566) matched with data from their pay-setting supervisors (N = 208), employed in a Swedish manufacturing company, were analyzed. Results of polynomial regression with response surface analysis show that employees’ perceptions of pay justice were important for their work-related attitudes and behaviors and that supervisor–employee congruence regarding pay justice was positively related to employees’ attitudes and behavior, particularly when the ratings concerned high levels of justice. The results not only highlight the importance of developing a pay system that is perceived as just by employees but also emphasize the importance of reaching a congruence between supervisors’ and employees’ perceptions of high fairness, as this has positive implications for employees’ attitudes and behaviors. In a special issue of “Ethics and Information Technology” (September 2012), various philosophers have discussed the notion of online friendship. The preferred framework of analysis was Aristotle’s theory of friendship: it was argued that online friendships face many obstacles that hinder them from ever reaching the highest form of Aristotelian friendship. In this article I aim to offer a different perspective by critically analyzing the arguments these philosophers use against online friendship. I begin by isolating the most common arguments these (...) philosophers use against online friendship and proceed to debunk them one by one by pointing out inconsistencies and fallacies in their arguments and, where needed, offering empirical findings from media and communication studies that offer a more nuanced view on online friendships. I conclude my analysis by questioning the correctness of the application of the Aristotelian theory of friendship by the critics of online friendship: in my view, the critics are applying the Aristotelian theory to online friendships in a rather narrow and limited way. Finally, I conclude my thesis by proposing that in the rapidly changing online landscape, a one-size-fits-all application of the Aristotelian theory on friendship is not sufficient to accurately judge the multitude of relationships that can exist online and that the various positive and valuable elements of online friendships should also be acknowledged and analyzed. This paper analyses the demands for abolishing passports after WWI. The international regime of obligatory passports, as it exists today, is a legacy of the Great War. After the Armistice, two Passport Conferences organized by the League of Nations considered its abolition. Before the second conference, a resolution of the Sixth Assembly of the League of Nations stated that "public opinion is certainly waiting for at least one step towards the most generalized abolition of the passport system ". Was this (...) just a diplomatic figure of speech, or is there really such an "expectation" to be found, for instance, in the press? If there was such an expectation in the press, what was the political orientation of the newspapers in favor of abolishing passports: was it left-wing? This article analyzes a corpus of over 600 articles published in the French press between the World Wars to show, firstly, that interest in the "abolition of passports" was not circumstantial. It's not because the League of Nations is discussing it that the press is discussing it - the opposite is true. The issue of the "abolition of passports" gave rise to a greater number of articles than the League’s "passport conferences". secondly, and more surprisingly, the newspapers that published the most articles on the abolition of passports were center-right and mostly regional. This article aims to reflect on the challenges of peace education in times of Covid-19 global pandemic from a positive perspective, understood as a new opportunity for education to consider the teaching of how to make peace from our daily experiences; and in this way, humanity can forge a more peaceful future. In this task, the use of imagination, fantasy and creativity as educational resources will be revalued. Likewise, utopia is proposed as that unknown horizon, still to come, that will (...) show us, in the face of so many doubts and uncertainties, those possible scenarios which will motivate us to continue working for cultures of peace. This reflection starts from the Reconstructive-Empowering Peace Education approach that I have been proposing in my research as a member of the Interuniversity Institute of Social Development and Peace. Using PitchBook’s private equity database of 4548 PE funds from 42 countries for the 2000 to 2012 period, we find that higher reporting frequency is associated with lower information asymmetry in performance reports from general partners to limited partners. We also find that endowments are systematically associated with less reported unrealized returns as a percentage of total returns generated from GPs. Moreover, endowments receive more performance reports from their PE funds, implying more stringent governance. These findings persist after controlling for (...) various institutional and GP characteristics and are robust to several adjustments for endogeneity concerns. This study also contributes to the finance, accounting, and business ethics literature on financial reporting quality. (shrink)

Harming other people is prima facie wrong. Unless we can be very certain that doing so is justified under the circumstances, we ought not to do it. In this paper, I argue that we ought to dismantle harsh retributivist criminal justice systems for this reason; we cannot be sufficiently certain that the harm is justified. Gregg Caruso, Ben Vilhauer and others have previously argued for the same conclusion; however, my own version sidesteps certain controversial premises of theirs. Harsh retributivist criminal (...) justice can only be morally right if the following three propositions are true: Moral responsibility exists, retributivism is right, and we can find out how much punishment offenders deserve for their crimes. Suppose that we initially assign a high credence to each of the three propositions; I assume for the sake of argument that there are good arguments in support of each. Nevertheless, these arguments ultimately depend on intuitions. Since we have philosophical peers whose intuitions differ from ours, we ought to downgrade our credence in each. However, even slightly less credence in each proposition means far less credence in a conjunction of all three. Since the stakes are high and there are morally safer options for a criminal justice system, we ought to dismantle harsh retributivist ones. (shrink)

It has been argued that we cannot be morally responsible in the sense required to deserve blame or punishment if the world is deterministic, but still morally responsible in the sense of being apt targets for moral criticism. Desert-entailing moral responsibility is supposed to be more freedom-demanding than other kinds of responsibility, since it justifies subjecting people to blame and punishments, is nonconsequentialist, and has been shown by thought experiments to be incompatible with determinism. Because the term ‘epigenetics’ has been used in a wide array of inquires within the life-sciences, it has come to bear a significant number of meanings. And just as biologists cannot come to an univocal understanding on what epigenetics connotes, the effect that its study has had in challenging contemporary neo-Darwinian, genecentred paradigms is also unclear. Some scientists and philosophers go as far as to say epigenetics has eroded dichotomies central to modern western thought, such as nature and nurture, or (...) genotype and phenotype – but the matter ignites a great deal of controversy. What seems unquestionable, however, is that the notion that genetic material is a ‘programme’ that simply manifests itself in an external correlative, thus accounting for the development of a living organism, seems to have – at the very least – shifted. Rather than attempting to pinpoint the implications of epigenetics in contemporary biology, this article focuses on the ‘literary’ dimension of scientific debate: instability of meaning, metaphorical shifts, a redrawing of margins and limits. Furthermore, it will be argued that metaphor does not merely have a pedagogical value in the field but rather works proactively throughout the genesis, development and morphology of science and theory. By outlining a ‘literary’ dimension in discussions around genetics one can identify what Squier refers to as ‘the epistemological value of the imprecise’, which in the case of epigenetics seems to have jeopardized not only the boundaries between genes and their external correlatives, but even challenged the frontiers of traditional disciplinary discourse. Methodological nationalism is the assumption that nation-states are the relevant units for analyzing social phenomena. Most of the social sciences recognized it as a source of bias, but not the ethics of immigration. Is this field biased by methodological nationalism—and if so, to what extent? This article takes nationalism as an implicit bias and provides a method to assess its depth. The method consists in comparing principles that ethicists commonly discuss when immigration is not at stake with principles advocated in (...) the ethics of immigration. To interpret the results, a distinction between mild and heavy bias is established. When a basic principle in ethics is underdiscussed or absent from the ethics of immigration, the field is ‘mildly biased’. When its negation is commonly advocated, the field is ‘heavily biased’. Here, the method is illustrated with two principles: equal opportunity and reparation. They are common in theories of distributive justice and of corrective justice, respectively. But in the ethics of immigration, scholars often argue for the opposite. Instead of equal opportunity, they implicitly support discrimination based on national origin; instead of sanctions or amnesty for the offenders, scholars plead amnesty for those who they otherwise regard as victims. These preliminary results suggest that the field is heavily biased: methodological nationalism seems to turn ethics into its opposite. (shrink)

This article presents the development, validation and application of an instrument to measure everyday moral distress in different health care settings. The concept of moral distress has been discussed and developed over 20 years. A few instruments have been developed to measure it, predominantly in nursing. The instrument presented here consists of two factors: level of moral distress, and tolerance/openness towards moral dilemmas. It was tested in four medical departments and three pharmacies, where 259 staff members completed a questionnaire. The (...) two factors were found to be reliable. Differences in levels of moral distress were found between pharmacies and clinical departments, and between the youngest and oldest age groups; departmental staff and the youngest group experienced higher levels of moral distress. Departments reported less tolerance/openness towards moral dilemmas than pharmacies. The instrument needs to be tested further, but its strengths are the focus on everyday ethical dilemmas and its usefulness in different health care settings. (shrink)

Background Respect is essential to providing high quality healthcare, particularly for groups that are historically marginalized and stigmatized. While ethical principles taught to health professionals focus on patient autonomy as the object of respect for persons, limited studies explore patients’ views of respect. The purpose of this study was to explore the perspectives of a multiculturally diverse group of low-income women living with HIV (WLH) regarding their experience of respect from their medical physicians. Methods We analyzed 57 semi-structured interviews conducted (...) at HIV case management sites in South Florida as part of a larger qualitative study that explored practices facilitating retention and adherence in care. Women were eligible to participate if they identified as African American (n = 28), Hispanic/Latina (n = 22), or Haitian (n = 7). They were asked to describe instances when they were treated with respect by their medical physicians. Interviews were conducted by a fluent research interviewer in either English, Spanish, or Haitian Creole, depending on participant’s language preference. Transcripts were translated, back-translated and reviewed in entirety for any statements or comments about “respect.” After independent coding by 3 investigators, we used a consensual thematic analysis approach to determine themes. Results Results from this study grouped into two overarching classifications: respect manifested in physicians’ orientation towards the patient (i.e., interpersonal behaviors in interactions) and respect in medical professionalism (i.e., clinic procedures and practices). Four main themes emerged regarding respect in provider’s orientation towards the patient: being treated as a person, treated as an equal, treated without blame or prejudice, and treated with concern/emotional support. Two main themes emerged regarding respect as evidenced in medical professionalism: physician availability and considerations of privacy. Conclusions Findings suggest a more robust conception of what ‘respect for persons’ entails in medical ethics for a diverse group of low-income women living with HIV. Findings have implications for broadening areas of focus of future bioethics education, training, and research to include components of interpersonal relationship development, communication, and clinic procedures. We suggest these areas of training may increase respectful medical care experiences and potentially serve to influence persistent and known social and structural determinants of health through provider interactions and health care delivery. he paper analyses migration flows from the Philippines in two gendered occupations: domestic helpers and computer programmers. The international division of labour theory claims that foreign investment determines migration from developing countries, especially of women, towards low-skilled gendered occupations in developed countries. This paper shows that the division of labour is neither gendered nor international in the predicted sense. For instance, data from Philippines Overseas Employment Agency shows that the theory is Eurocentric as Northern America and Europe are destinations for (...) only 3 per cent of domestic workers’ flows. The paper argues that neo-Marxism creates bias in gender and migration research and hinders understanding of important gendered effects concerning migrants. Two examples of such gendered effects are highlighted here: the higher vulnerability to legislative change of migrant men employed as domestic workers in Italy and the higher penetration of women into computer programming in the migrant flows to the U.S. (shrink)

One of the most influential arguments against compatibilism is Derk Pereboom’s four-case manipulation argument. Professor Plum, the main character of the thought experiment, is manipulated into doing what he does; he therefore supposedly lacks moral responsibility for his action. Since he is arguably analogous to an ordinary agent under determinism, Pereboom concludes that ordinary determined agents lack moral responsibility as well. I offer a hard-line reply to this argument, that is, a reply which denies that this kind of manipulation is (...) responsibility undermining. I point out that fully fleshed-out manipulated characters in fiction can seem morally responsible for what they do. This is plausibly because we identify with such characters, and therefore focus on their options and the reasons for which they act rather than the manipulation. I further argue that we ought to focus this way when interacting with other agents. We have no reason to trust the incompatibilist intuitions that arise when we regard manipulated agents from a much more detached perspective. (shrink)

Praise, unlike blame, is generally considered well intended and beneficial, and therefore in less need of scrutiny. In line with recent developments, we argue that praise merits more thorough philosophical analysis. We show that, just like blame, praise can be problematic by expressing a failure to respect a person’s equal value or worth as a person. Such patronizing praise, however, is often more insidious, because praise tends to be regarded as well intended and beneficial, which renders it harder to recognize (...) and object to. Among other things, a philosophical analysis of patronizing praise helps people on the receiving end articulate why they feel uncomfortable or offended by it, shows patronizing praisers how their praise is problematic, and provides input for further philosophical analysis of blame.In the first section of the paper, we discuss how hypocritical praise, just like hypocritical blame, can fail to respect the equality of persons by expressing that the praiser applies more demanding moral standards to the praisee than to themself. We further discuss obstructionist praise, which loosely corresponds to complicit blame, and can similarly express that certain moral standards apply to others but not to the praiser. In the second part of the paper, we discuss another variety of patronizing praise. Praise can be an inaccurate appraisal of a person based on irrelevant considerations – like race, gender, or class – and thereby constitute a failure to recognize their equal worth as a person. It has been argued that in a deterministic universe, no one has any reason to do anything. Since we ought to do what we have most reason to do, no one ought to do anything either. Firstly, it is argued that an agent cannot have reason to do anything unless she can do otherwise; secondly, that the relevant ‘can’ is incompatibilist. In this paper, I argue that even if the first step of the argument for reason incompatibilism succeeds, the second (...) one does not. It is argued that reasons require alternative possibilities, because reasons are action-guiding. A supposed reason to do the impossible, or to do what was inevitable anyway, could not fill this function. I discuss different interpretations of the claim that reasons are action-guiding, and show that according to one interpretation it is sufficient that the agent believes that she has several alternative options. According to other interpretations, the agent must really have alternative options, but only in a compatibilist sense. I suggest that an interpretation of action-guidance according to which reasons can only guide actions when we have several options open to us in an incompatibilist sense cannot be found. We should therefore assume that reasons and obligations are compatible with determinism. (shrink)

Embora Rawls defenda que a concepção de Identidade Pessoal de que a teoria da justiça necessita é neutra e abstracta, a autora do artigo procura, concretamente à luz da análise de três dimensões da Identidade Pessoal (cognitiva, metafisica e narrativa) na filosofia da mente e da acção, decidir se tal (...) posição é ou não defensável. /// Aim of the present article is first of all to characterize the Rawlsian conception of personal identity in the original position (both in A Theory of Justice and in Political Liberalism). Rawls sometimes claims that the conception of personal identity necessary for his theory of justice is abstract and neutral, but that claim must be assessed. The author of the article assesses that claim precisely from the point of view of contemporary philosophy of mind and action. Three dimensions of the problem of personal identity -cognitive, metaphysical and narrative - are thus analysed in order to bring forth the ways in which decisions concerning each dimension weigh on the Rawlsian theory of justice. Background: The theoretical framework of Jϋrgen Habermas suggests that effective communication requires competent participants with an objective attitude that complies with the rules and worlds designated as objective, social and subjective. This situation determines communicative action, which stimulates the search for mutual understanding and results in a process of interaction that promotes self-determination. Objectives: In this study, the discharge letters of patients with myocardial infarction were explored regarding the provision of information. The patient’s right to information and the duty of (...) informing were analysed according to the perspective of Jϋrgen Habermas. Research design: This was a cross-sectional analysis (from a broader longitudinal study) of all discharge letters that were directly related to nursing interventions regarding the provision of information to 106 patients. In this major study, the difficulties faced by patients who experienced a myocardial infarction and the changes in their lifestyles were analysed based on the type of information received. Ethical considerations: The hospital Ethics Committee approved the study, which complied with ethical principles and required informed consent. Findings: In the nursing letters, interventions related to the provision of information were conducted at an average of 3.59 interventions per patient. For 8.5% of the patients, however, no interventions related to the provision of information were performed. The most common area of information during hospitalisation was related to the management of signs and symptoms and applied to 90.6% patients. Discussion: The nursing interventions did not cover patient education, transition processes or awareness of the disease. Thus, the right to information can be questioned. Conclusion: Information is a right, and communication is extremely important. Health professionals should be aware of this importance regarding both care management and the satisfaction guarantee. The sharing of information by health professionals based on their competency is essential for patients to exercise their right to self-determination and decision-making. (shrink)

L’utilisation des énergies renouvelables en Inde est en train de modifier (ou de maintenir) le modèle de croissance et de développement inégal qui la caractérise comme « économie émergente ». Nous mettons l’accent sur deux processus contrastés que connait l’Anantapuramu, un district rural marqué par des indices de pauvreté et de vulnérabilité climatique élevés. D’un côté, le développement de méga-infrastructures d’énergie éolienne déclenche une transformation régionale en faveur de « l’industrialisation verte ». De l’autre, la résistance du Collectif Timbaktu, une (...) organisation de base qui travaille à la régénération des terres communales « improductives », promeut la gestion collective des ressources et renforce les relations de coopération au sein des communautés locales. Cette perspective contrastée permet de mettre à jour les différentes façons de comprendre la durabilité et ses implications politiques dans les dynamiques écologiques, sociales et spatiales des territoires concrets. Dans l’opinion publique, la migration « irrégulière » est associée à l’entrée et au séjour non autorisés. Un nombre croissant d’études indiquent toutefois qu’elle résulte de la production de catégories légales de séjour autorisé. Le présent chapitre enrichit cette littérature, en montrant comment la construction de la catégorie légale de travail autorisé est productrice d’immigration « irrégulière ». En effet, la multiplication des conditions d’accès à l’autorisation de travail a pour effet de priver de droit au séjour des personnes autrement (...) en situation régulière. La France, située en tête de classement en matière d’obligations de quitter le territoire et en fin de classement en matière d’immigration professionnelle, représente un cas d’école parmi les pays de l’Union Européenne. This paper goes beyond critiques of western philosophical notions of space as passive, feminine, and unintelligent by reconfiguring containment as an active process. The author draws on work in the history of technology, on a cybernetic epistemology that emphasizes the interdependence of organism and environment, and on intersubjectivist psychoanalytic theories of the maternal provision. A more unexpected ally is found in Heidegger, whose writings on holding and supply are read in ways that contribute to the development of an urgently required (...) philosophy of container technologies. The aim of this article is to show that refusing to legalize the status of undocumented immigrants who have been long-term residents is a serious violation of human rights. The "right to have rights" ­ a term coined by Hannah Arendt and developed by Sheila Benhabib ­ should be construed first and foremost as the right to a legal existence. We take issue with consequentialists who warn that legalizing the status of undocumented aliens will encourage further undesirable immigration, for withholding (...) legal status in order to deter illegal newcomers is neither efficacious nor just. We conclude that "selective" as opposed to "endured" immigration policies are ethically untenable. (shrink)

En 2010, les femmes constituaient la majorité des migrants qualifiés présents dans 20 pays membres de l’OCDE. Comment expliquer l’absence d’intérêt pour le phénomène de « féminisation de la migration qualifiée » que ces statistiques permettent d’observer ? À l’inverse, comment comprendre l’engouement pour l’expression « féminisation de la migration » (tout court) alors que les données ne la confirment pas ? Pour répondre à ces questions, cet article analyse les usages de l’expression « féminisation de la migration » et (...) identifie son origine dans la théorie de la division internationale du travail. Centrée sur une critique de la mobilité du capital, cette théorie prédit une féminisation de la migration et l’associe aux emplois peu qualifiés. Cependant, les recherches qui s’en inspirent risquent de perdre de vue le diplôme de l’enseignement supérieur qui représente le véritable passeport pour les femmes originaires des pays en développement. In this dissertation, I argue for what I call “practical perspective compatibilism”. According to this thesis, an agent with practical freedom is sufficiently free to be a moral agent and morally responsible for his or her actions. The concept of practical freedom is originally found in the writings of Kant. Kant argued that we can view the world from either a theoretical or a practical perspective. The theoretical perspective is that of causal explanation and prediction, whereas the practical perspective is (...) that of choosing what to do and how to act. We see that we are free when we view things from a practical perspective. Determinism cannot threaten our practical freedom, since from a practical perspective we must choose what to do even if everything ultimately is determined. I argue that practical freedom is sufficient freedom-wise for moral agency and moral responsibility because morality is action-guiding. Right and wrong are concepts to be employed in deliberation and advice. This is a strong reason to regard factors irrelevant to deliberators and advisers as irrelevant when making judgements of right and wrong, and whether somebody had some other kind of freedom than practical freedom is irrelevant to deliberators and advisers. There are also prima facie reasons to regard moral responsibility as tied to rightness and wrongness, so that agents are blameworthy when they did wrong and praiseworthy when they did right. I also show that no classic arguments for incompatibilism about determinism and moral responsibility work when directed against practical perspective compatibilism. Finally, this thesis discusses metaethics in relation to compatibilism. Since competing theories imply the falsity of some respected metaethical positions, metaethical considerations lend further support to practical perspective compatibilism. (shrink)
